Smelled like cigarettes, owner very unprofessional when I was in an emergency

Self inflicted issues, specifically running out of gas, is not an emergency for responsible adults. A responsible adult would’ve made certain that fuel/gas was in the vehicle, knowing that it was being returned. Especially when you’re over 100 miles away from the location that you’re supposed to return the vehicle.
